What is a Will?

A Will is a legal document that leaves instructions about what you want done with your money, real or personal property and other personal possessions or assets after you die. A Will can also set out plans to take care of your children or other family members

In other words, a Will specifies:
  • who will carry out your wishes (an executor or estate trustee)
  • who gets what after you die (who will inherit money or property from you)
  • who will take care of your children if both parents are gone

What happens if I die without a will?

Dying without a Will is called dying "intestate". If you die intestate, the Court sets out how your assets will be distributed rather than you or your family deciding. You lose control over what happens when you die.

Do I need a lawyer to help me with my will?

You do not have to hire a lawyer to write your Will. However, it may be advisable to hire one in the following circumstances:

  • if you have children
  • if you care for someone who has special needs
  • if you own property (personal or land/building)
  • if you own a business
